On or about October 23, 2007, the motor vehicle accident in question occurred between a vehicle driven by the Defendant, Edna Gonzalez, and the vehicle driven by Ruben Dominguez, Jr., on Highway 285, in Brooks County, Texas. Belinda Valdemar was a passenger in the vehicle driven by Ms. Gonzalez. Both Ms. Gonzalez and Ms. Valdemar were killed in the accident. Plaintiffs allege that Ms. Gonzalez was driving negligently and that her negligence was a proximate cause of the accident and the resulting death of Ms. Valdemar. Plaintiffs also allege that Ms. Gonzalez was in the course and scope of her employment with Health Care Unlimited, Inc. at the time of the accident. The Defendant, Health Care Unlimited, Inc., admitted that Ms. Gonzalez was its employee but denied that Ms. Gonzalez was in the course and scope of her employment at the time of this accident. Health Care Unlimited, Inc. claimed that Ms. Gonzalez and Ms. Valdemar were friends apart from work, and they were together, as friends, not as a home provider and client, when the accident happened.
